July 2, 2009 (LPAC)— After a first wave of euphoria on the part of the Eurocrats that the German Supreme Court did not throw out the Lisbon Treaty as a whole, a sobering effect has set in, with numerous media voicing concern that the conditions which the Court posed for the Treaty's validity on German territory, are of a nature that paralyzes substantial aspects of the Treaty. Indicative of the sober media tone was Der Spiegel's online service which warned that for Brussels and the eurocrats, there is no reason to be euphoric, quite the contrary, there are many new hurdles now to be cleared, with that Court ruling. Furthermore, if the revised legislation which the German parliament has to come up with, to meet the Court's conditions, lag behind, the plaintiffs in this court case will take the matter to the Court again.

Among the conditions the Court imposed, are restrictions to the Lisbon Treaty's flexibility clauses that envisage an automatism of decrees, uninfluenced by any democratic or parliamentary procedure in the nation-states of Europe. The Court ruled that substantial changes in European policies that affect central clauses of the German Constitution, always will require the explicit consent of the German state bodies. As for the statehood, the sovereignty of Germany as such, no transfer to any other body or institution is permitted, if not explicitly approved by the Germans, and that would have to require a referendum according to Art. 146 of the constitution, for example.

The effectiveness of the defense of Germany, however, depends on the quality of the politicians and members of Parliament, and in order to make sure that the new German Parliament that takes office after the September national elections, is up to the job, the BueSo is calling on the electorate to vote BueSo candidates into the new Bundestag, because the BueSo has always opposed the entire Lisbon Treaty project from the start. BueSo national chairwoman Helga Zepp-LaRouche has announced a campaign statement to address these issues.
